Service Availability
Because of variations in the telephone company wiring infrastructure, ConnectSouth cannot guarantee that a particular service or speed will be available to you until we actually complete the service set-up, even if we believe that it should be available and accept an order for it. All orders are subject to downgrade or cancellation as a result of unforeseen problems with the wiring infrastructure. However, statistically, the vast majority of the orders we accept are successfully installed at the speed offered when the order was received, and we are constantly refining our ordering tools to further improve their accuracy.
Safe Harbor Statement - Private Securities Litigation Reform Act of 1995
The statements contained in this web site, which are not historical facts, may be deemed to contain forward-looking statements, including, but not limited to, deployment, scalability and integration of ConnectSouth’s network in new and existing regions and the timing and breadth of coverage in each region. Actual results may differ materially from those anticipated in any forward-looking statements as a result of certain risks and uncertainties, including, without limitation, ConnectSouth’s dependence on strategic third parties to market and resell its services, intense competition for service offerings, dependence on growth in demand for DSL-based Internet services, availability of collocation space, loops and facilities, ability to manage and scale operations, and other risks and uncertainties detailed in the Company's Securities and Exchange Commission filings. ConnectSouth disclaims any obligation to update information contained in any forward-looking statement.
ConnectSouth Web Site Practices
Goals
ConnectSouth's goals are to provide an interactive customer web site highlighting our high-speed Internet connectivity and Internet Business Tools. We endeavor to protect network resources, preserve the privacy and security of ConnectSouth and our customers' networks, and maximize the effectiveness of ConnectSouth and our Internet services, while recognizing ConnectSouth's position in the Internet community.
Interpretation
The provisions of this Policy are intended as guidelines and are not meant to be exhaustive.
Generally, conduct that violates law, regulation, or the accepted norms of the Internet community, whether or not expressly mentioned in this Policy, is prohibited. ConnectSouth reserves the right at all times to prohibit activities that damage its commercial reputation and goodwill.
Security
Any "denial of service" attacks, any attempt to breach authentication or security measures, or any unauthorized attempt to gain access to any other account, host or network is prohibited, and will result in immediate service termination, which may be without notice.
Copyright, Privacy, and Intellectual Property
Using a ConnectSouth connection to commit, aid or abet any violation of copyright or intellectual property law is prohibited.
This prohibition includes publishing a private email message to third parties, by any means, without the express prior consent of the author.
The email addresses of ConnectSouth subscribers are not for sale or commercial distribution to third parties without the express prior consent of the subscriber.
Cooperation with Other Providers
Using ConnectSouth's facilities to engage in activities that violate the Terms of Service of any other network access provider is prohibited. For example, sending unsolicited commercial email through ConnectSouth's facilities to the subscribers of any Internet or online service provider that disallows unsolicited commercial email is prohibited.
Email Usage
Using any ConnectSouth account or server to send duplicative, unsolicited email messages (commercial or otherwise), or to collect the responses from unsolicited email, is prohibited.
Similarly, using any ConnectSouth account or server to post advertisements or messages that violate the charter of the account is prohibited. ConnectSouth reserves the right to make the determination whether a given message violates account charter. Commercial messages that are appropriate under the charter of a newsgroup or mailing list, or that are expressly solicited by the recipients, are permitted.
Conduct in connection with email that is an obvious nuisance (such as "mail bombing") or that would be unlawful in other contexts (for example, threats, harassment, defamation, obscenity, or software piracy) is prohibited.
IRC (Internet Relay Chat)
Using programs that interfere with others' use, or running an IRC robot, on any IRC server is prohibited. When logged into any IRC server, users are expected to comply with the rules and policies established by the server's administrator.
Forgery of Identity
Falsifying addressing information or otherwise modifying headers to conceal the sender or recipient's identity, for the purpose of circumventing this Policy, is prohibited. This provision is not intended to disallow the use of aliases or anonymous remailers for any legitimate purpose.
Broadcast Echo Requests (Smurf Attacks)
ConnectSouth is committed to implementing the configuration required to ensure that ConnectSouth infrastructure cannot be used as the host of smurf attacks.
There are two types of network numbers in the smurf list that reflect a connection with ConnectSouth: Customer network numbers for which we do not have control and backbone addresses.
ConnectSouth Customer Support is working with all customers on ConnectSouth to ensure that their networks cannot be used as amplifiers for Broadcast Echo Requests.
Consequences of Violation
Violation of this Policy by a ConnectSouth customer may result in temporary suspension or permanent termination of service, at ConnectSouth's sole discretion.
ConnectSouth does not issue service credits for any outages incurred through service disablement resulting from Policy violations.
Modification
ConnectSouth reserves the right to add, delete, or modify any provision of this Policy at any time without notice.
